Terms of Use

These Terms of Use govern your use of RunnerCast, an iOS application developed and operated by James Koole ("we," "us," or "our"), a sole proprietor based in Ontario, Canada. By downloading or using RunnerCast, you agree to these terms. If you do not agree, do not use the app.
1. About RunnerCast
RunnerCast provides weather-based running condition scores to help you decide when to head out for a run. Scores are generated using current and forecast weather data and are intended as a general guide only. They are not a substitute for your own judgment, local knowledge, or awareness of your personal fitness and health.
2. Acceptance of Terms
These Terms of Use constitute a binding agreement between you and James Koole. Your continued use of RunnerCast following any updates to these terms constitutes acceptance of those changes. We will update the "Last updated" date at the top of this page when changes are made.
This agreement incorporates Apple's Licensed Application End User License Agreement where applicable. In the event of any conflict, these custom terms govern your use of RunnerCast.
3. Eligibility
You must be at least 13 years of age to use RunnerCast. By using the app, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these terms on your behalf.
4. Subscriptions and Billing
RunnerCast offers a free tier with limited features and a paid subscription called RunnerCast Crew, available at monthly and annual pricing.
Free Trial
RunnerCast Crew may include a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.
Billing
All billing is handled by Apple through the App Store. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal. Payment is charged to your Apple ID account at confirmation of purchase.
Cancellation
You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods, though you may be eligible for a refund under Apple's own refund policies.
Price Changes
We may change subscription pricing with reasonable notice. Continued use of RunnerCast Crew after a price change takes effect constitutes your acceptance of the new pricing.
5. Weather Data and Accuracy
RunnerCast uses weather data provided through Apple WeatherKit. Weather forecasts and current conditions are inherently uncertain and may not reflect actual conditions at your location or during your run.
Running condition scores are calculated algorithmically based on available weather data. They are provided for informational purposes only. We make no representations or warranties regarding the accuracy, completeness, or reliability of the weather data or the scores derived from it.
You assume full responsibility for any decisions you make based on information provided by RunnerCast, including decisions to run in particular weather conditions.
6. Health and Safety Disclaimer
Running carries inherent physical risk. RunnerCast is not a medical application and does not provide health or medical advice. Nothing in the app should be interpreted as a recommendation to run in conditions that may be unsafe for your personal health, fitness level, or circumstances.
Always consult a qualified medical professional before beginning or modifying an exercise program. Pay attention to your own body, local weather warnings, and applicable public safety advisories regardless of what RunnerCast displays.
7. Artificial Intelligence Features
RunnerCast may use on-device AI capabilities, including Apple Intelligence, to generate natural language explanations of running condition scores. These explanations are produced automatically and may not always be accurate or appropriate for your specific situation. They are supplementary to the numeric score and subject to the same informational-use-only limitations described in these terms.
8. Intellectual Property
RunnerCast, including its name, logo, design, scoring algorithm, and all related content, is the intellectual property of James Koole and is protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works from any part of RunnerCast without our prior written consent.
9. Prohibited Use
You agree not to:
- Use RunnerCast for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the source code of the app
- Interfere with or disrupt the operation of RunnerCast or any associated services
- Use automated tools to access or scrape data from the app
10. Privacy
Your use of RunnerCast is also governed by our Privacy Policy. The Privacy Policy describes what information we collect, how we use it, and your rights with respect to that information.
11. Disclaimer of Warranties
RunnerCast is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of harmful components. Your use of RunnerCast is at your sole risk.
12. Limitation of Liability
To the maximum extent permitted by applicable law, James Koole shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of RunnerCast, including but not limited to damages resulting from reliance on weather scores or running condition assessments provided by the app.
Our total liability to you for any claims arising under these terms shall not exceed the amount you paid for RunnerCast in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless James Koole from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of RunnerCast or your violation of these terms.
14. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
15. Changes to the App
We reserve the right to modify, suspend, or discontinue RunnerCast or any part of it at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
16. Third-Party Services
RunnerCast is distributed through the Apple App Store and uses services provided by Apple Inc., including WeatherKit. Your use of Apple's services is subject to Apple's own terms and privacy policies, which are separate from these terms and are Apple's responsibility.
17. Severability
If any provision of these terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and James Koole with respect to RunnerCast and supersede all prior agreements or understandings.
